Terms of service

1. General Information

Welcome to MLVaccaroStudio (the "Webshop"). These Terms of Service ("Terms") govern your use of our webshop and your purchase of photographic art prints produced through Gelato, a print-on-demand service.

By accessing and using this Webshop, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Webshop.

2. Products and Description

We sell custom-made photographic art prints. Our products are made-to-order items produced specifically for you upon purchase, produced by Gelato based on your order specifications, and subject to variations due to the nature of print-on-demand technology.

2.1 Color Accuracy

We strive to display our products as accurately as possible. However, due to variations in monitor settings and the nature of print-on-demand technology, actual colors may vary slightly from what you see on your screen.

Please note: Monitor display settings vary widely between devices. Lighting conditions and calibration affect how colors appear digitally. Print-on-demand printing may produce slight color variations within acceptable tolerances. We cannot guarantee exact color matching to your monitor display.

If color accuracy is important for your purchase, we recommend reviewing product descriptions carefully and considering our color variation policy in the Return & Refund section.

2.2 Image Resolution and Quality

The quality of your printed product depends on the resolution and quality of the image file you upload. We recommend uploading high-resolution images (minimum 300 DPI at print size), using images with appropriate dimensions for the product size you select, and testing your image quality through Gelato's preview tools before ordering.

We do not accept responsibility for poor print quality resulting from low-resolution image files or improper file formatting.

2.3 Print Variations

Small variations in color, image placement, and finish may occur due to the nature of print-on-demand manufacturing. These variations do not constitute a defect unless they significantly affect the product's appearance or use.

Acceptable variations may include minor color shifts within ±5% of the intended color, image placement variation of ±2mm, and natural variations in paper texture or matte finish.

3. Intellectual Property & Content Rights

You represent and warrant that you own or have the right to use all images, artwork, and content you upload. The content does not infringe any third-party intellectual property rights. You have the legal right to reproduce the content on printed products. The images and content are not copied from copyrighted, trademarked, or protected sources without permission.

If your order violates intellectual property rights, we reserve the right to cancel it without liability.

3.1 Copyright Responsibility

You are solely responsible for ensuring that your uploaded images and content are original works created by you, or are licensed or have explicit permission from the copyright holder, and do not violate any intellectual property laws.

Examples of content we cannot print without explicit written permission include images of trademarked logos or branded characters, celebrity photographs or images of recognizable people, images copyrighted by other photographers or artists, and licensed stock photos unless you have a commercial license.

Violation of intellectual property rights may result in legal action against you.

4. Order and Payment

Orders are placed through our Webshop and require a valid image file upload, specification of product size and type, valid payment method, and acceptance of these Terms of Service.

4.1 Order Confirmation

Once you place an order, you will receive an order confirmation email. This email confirms your order number (for reference and claims), product specifications (size, type, quantity), total price including VAT/GST where applicable, and estimated delivery time.

Please review this confirmation carefully. Contact us within 24 hours if you notice any errors.

4.2 Payment Methods

We accept credit/debit cards (Visa, Mastercard, American Express), digital payment services (PayPal, Apple Pay, Google Pay, etc.), and other payment methods as displayed at checkout.

All payments are processed securely. We do not store full credit card details on our servers.

4.3 Pricing and Taxes

Prices displayed on our Webshop are in EUR (Euros) and exclude VAT/GST where applicable. The final price including all taxes will be calculated at checkout based on your delivery location.

Additional charges may apply for international shipping and customs fees, special courier delivery methods, and import duties for deliveries outside Denmark. These additional costs are displayed before you complete your purchase.

5. Delivery and Shipping

Gelato handles all manufacturing, packaging, and shipping of your order.

5.1 Delivery Times

Standard delivery takes 7-14 business days from order confirmation. Express delivery (3-5 business days) is available where applicable with additional cost. International delivery times may be longer and subject to customs clearance.

Delivery times are estimates and not guaranteed. Delays may occur due to production delays at Gelato, shipping carrier delays, customs clearance for international orders, and weather or unforeseen circumstances.

5.2 Shipping Address

You are responsible for providing an accurate shipping address at checkout. We cannot be held responsible for orders delivered to incorrect addresses provided by you.

5.3 Package Inspection

Upon receiving your package, please inspect it immediately for visible damage to the packaging, missing items or incorrect quantity, and defects in the print quality or product.

If damage is visible, document it with photos and contact us within 24 hours. Delayed damage reports may not be processable.

6. Product Quality & Responsibility

MLVaccaroStudio acts as the merchant of record and direct point of contact. However, Gelato manufactures and ships all products.

6.1 Quality Standards

Gelato maintains quality standards for manufacturing and packaging. We take responsibility for communicating defects to Gelato and processing replacements. Manufacturing or shipping defects are covered under our Return & Refund Policy.

6.2 Not Our Responsibility

We are not responsible for poor quality due to low-resolution image uploads, color variations from your monitor display, damage caused by mishandling after delivery, or normal wear and tear from use or display.

7. Limitation of Liability

To the fullest extent permitted by law, MLVaccaroStudio and Gelato shall not be liable for indirect, incidental, special, or consequential damages, loss of profit, revenue, or business opportunities, lost data or reputational harm, or delays or failures in delivery outside of our control.

Our total liability for any claim shall not exceed the purchase price of the product in question.

8. Indemnification

You agree to indemnify and hold harmless MLVaccaroStudio from any claims, damages, or expenses arising from your use of the Webshop in violation of these Terms, your violation of third-party intellectual property rights, or your misuse of uploaded content or images.

9. Prohibited Use

You agree NOT to use the Webshop to upload illegal, offensive, or defamatory content, infringe on others' intellectual property rights, violate any applicable laws or regulations, spam, harass, or threaten other users, or attempt to hack, disrupt, or damage the Webshop.

Violation of these rules may result in suspension or termination of your account.

10. Account and Cookies

If we use cookies on our Webshop, they are used to remember your preferences and shopping cart, analyze website usage through analytics, and provide essential functionality.

You can disable cookies in your browser settings, but this may affect Webshop functionality.

11. Data Protection and Privacy

Your personal data (name, email, address) is collected and processed according to our Privacy Policy, which complies with GDPR (General Data Protection Regulation), Danish Data Protection Act, and EU and Danish consumer protection laws.

We do not sell your personal data to third parties. Data is used only for order processing and customer service.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Modified" date. Your continued use of the Webshop after changes constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by Danish law (Dansk ret) without regard to conflicts of law principles.

For customers within the EU: You have the right to pursue complaints through our customer service (mlvaccarostudio@gmail.com), your national consumer protection authority, the European Consumer Centres Network (https://www.eccnet.eu/), or alternative dispute resolution services available in your country.

You may bring legal action in Danish courts or the courts of your country of residence (EU consumers).

15. Severability

Return & Refund Policy (European Union)

Overview

Our webshop is based in Denmark and sells customized photographic art prints produced through Gelato, a print-on-demand service. This policy applies to all customers purchasing from our store within the European Union, including Denmark, and outlines your rights and our obligations under EU consumer protection law.

Right of Withdrawal (14-Day Cooling-Off Period)

Under the EU Consumer Rights Directive 2011/83/EU, consumers have the right to cancel purchases made online or at a distance within 14 days.

However: Because our products are made-to-order and clearly personalized based on your specifications, the 14-day cooling-off period does NOT apply to your purchase. This exemption is explicitly recognized in EU law for customized goods.

What this means:

  • You cannot withdraw your order because you changed your mind
  • You cannot cancel for reasons of preference, color, or size selection
  • Once your order is confirmed, it enters production with Gelato

Legal Warranty on Defects (2-Year Guarantee)

Under EU consumer law, all goods sold to consumers come with rights for defective products, faulty items, or goods not matching the description. This 2-year warranty applies regardless of our policy and cannot be waived.

What is guaranteed:

  • Manufacturing defects in printing, paper quality, or color accuracy
  • Shipping damage caused during transport
  • Products that don't match your order (wrong file printed, wrong dimensions, etc.)

What is NOT guaranteed:

  • Color variations within normal printing tolerances (monitor colors differ from printed results)
  • Normal wear from use or display
  • Damage caused by mishandling after delivery
  • Issues arising from image quality or resolution of your uploaded file

How to Report a Defect (Filing a Complaint)

If you receive a defective, damaged, or incorrect product:

  1. Contact us within 30 days of delivery (ideally for fastest resolution):

  • Include: Order number, date received, and brief description of the issue
  1. Provide evidence:
  • Clear, well-lit photographs of the defective product
  • Photos of packaging (if relevant to transportation damage)
  • Original order confirmation
  1. Our response:
  • We will verify your claim with Gelato within 5-10 business days
  • If approved, we arrange a replacement at no cost to you
  • Gelato covers all costs for replacement orders due to verified defects

Refunds

Refunds are approved only in these circumstances:

  1. Manufacturing defect that cannot be replaced: If Gelato cannot produce a working replacement after defect verification
  2. Shipping loss: If the product is permanently lost in transit (requires tracking evidence)
  3. Unresolvable quality issue: If the defect cannot be rectified through replacement

How refunds work:

  • All refunds are processed by Gelato to your original payment method
  • Refunds are issued within 14 days of approval
  • Refund includes the full purchase price (no deduction for "wear" since products are new)

Shipping Costs & Return Logistics

Important: The cost of returning a defective product is the responsibility of the trader (us).

  • You do not pay for return shipping if reporting a defect
  • We will provide a return label or shipping instructions
  • Once we receive and verify the defect, you receive either a replacement or refund

If you choose to return a non-defective product (outside our policy):

  • You pay for return shipping
  • This is your choice—we cannot force you to return it
  • We will only refund if we receive proof it was defective

Cross-Border Purchases

The rights outlined in this policy apply across borders, meaning consumers from any EU member state have the same rights as Danish consumers. Return shipping may be more expensive internationally, but this does not change your rights or our obligations.

Important: If a dispute arises about your consumer rights in a cross-border sale, the European Consumer Centres Network provides free legal advice and can help with cross-border purchasing issues.

Your Statutory Rights Summary

This policy does NOT limit or override your legal rights under:

  • EU Consumer Rights Directive 2011/83/EU
  • National consumer protection laws of your country
  • Your right to a 2-year legal warranty on defects

If we cannot resolve your complaint satisfactorily, you may:

  1. Contact your national consumer protection authority
  2. File a complaint with your country's European Consumer Centre
  3. Use EU alternative dispute resolution services
  4. Pursue legal action in your country's consumer courts

Changes to This Policy

From June 2026, EU consumer protection rules are being strengthened with additional requirements. We will update this policy to reflect any new regulations. Changes will be posted on our website and customers will be notified.

Retur- og Refundpolitik

Fortrydelsesret (14-dages cooling-off period)

Når du køber fra vores webshop, har du som forbruger normalt 14 dages fortrydelsesret fra det tidspunkt, du modtager din ordre.

Dog: Da vores produkter er specialfremstillede fotokunst produceret af print-on-demand partner Gelato baseret på dine specifikationer, gælder fortrydelsesretten ikke for dine køb. Dette er i overensstemmelse med dansk forbrugeraftalelov, som undtager specialfremstillede varer fra fortrydelsesretten.

Reklamationsret (2-årig warranty på defects)

Ifølge dansk købelov har du 2 års reklamationsret fra leveringsdatoen. Hvis dit produkt har en fabrikationsfejl eller skade fra transport, kan du klage inden for denne periode.

Hvad er dækket af reklamationsretten:

  • Fabrikationsfejl ved print eller materiale
  • Beskadigelse under transport fra Gelato
  • Produkter, der ikke stemmer overens med din ordre

Hvad er IKKE dækket:

  • Normale slidmærker fra brug
  • Farveafvigelser inden for acceptable tolerance-niveauer (som følge af printer-processen)
  • Skader forårsaget af uheldige eller fejlagtig håndtering efter modtagelsen

Hvis du modtager en beskadiget eller fejlproduceret vare:

Hvor: Alle godkendte refunder behandles fra Gelato direkte til din oprindelige betalingsmetode.

Vigtige bemærkninger

Transportskader: Vi kan ikke påtage os ansvar for skader, der opstår efter at varen er kommet i din besiddelse. Inspicér din vare omhyggeligt ved modtagelse. Hvis emballagen er beskadiget, skal du helst dokumentere det straks og kontakte os hurtigst.

Gelatos ansvar: Gelato dækker omkostninger for erstatningsvarer ved fabrikations- eller transportfejl. Som din sælger arbejder vi sammen med Gelato for at sikre, at du får den rette løsning.

Foretrukne håndtering: Mens du teknisk har 2 år til at klage, behandler vi klagerne hurtigst og nemmest, hvis du kontakter os inden for 30 dage. Efter denne periode kan det være svært at verificere transport- eller produktionsfejl.

Din juridiske ret (Dansk Købelov)

Uanset denne politik har du altid en lovbestemt ret til at klage over varer med fejl, der dukker op inden for 2 år efter købet. Du kan kræve reparation, erstatning eller i visse tilfælde pengene tilbage. Vi opfordrer dig til at benytte denne ret gennem os ved at kontakte vores kundeservice.

Tilknyttet ret: Hvis vi ikke kan løse problemet tilfredsstillende, kan du indgive klage til Forbrugerklagenævnet eller kontakte Forbrugerombudsmanden.

Return & Refund Policy

Cooling-Off Period (14-Day Right of Withdrawal)

When you purchase from our webshop, you normally have 14 days to withdraw from your purchase as a consumer.

However: Because our products are custom-made photographic art produced by our print-on-demand partner Gelato based on your specifications, the right of withdrawal does not apply to your purchases. This is in accordance with Danish consumer law, which exempts custom-made products from the withdrawal right.

What this means:

  • You cannot withdraw your order because you changed your mind
  • You cannot cancel for reasons of preference, color, or size selection
  • Once your order is confirmed, it enters production with Gelato

Warranty Rights (2-Year Legal Warranty Against Defects)

Under Danish purchase law (Købeloven), you have 2 years from the delivery date to claim for defects. If your product has a manufacturing fault or shipping damage, you can file a complaint within this period.

What is covered by the warranty:

  • Manufacturing defects in printing or materials
  • Damage during transport from Gelato
  • Products that don't match your order specifications

What is NOT covered:

  • Normal wear and tear from use
  • Color variations within acceptable tolerance levels (inherent to the printing process)
  • Damage caused by mishandling or improper care after delivery

How to File a Claim

If you receive a damaged or incorrectly printed product:

  1. Contact us as soon as possible (ideally within 30 days of receipt for fastest processing):

  • Photos of packaging (if relevant to shipping damage)

  • We verify the damage/defect with Gelato
  • If approved: We arrange a replacement product to be sent to you at no additional cost
  • Gelato covers all costs for replacement orders related to verified production or shipping defects

Refunds

Refunds are granted only in the following circumstances:

  • Gelato cannot deliver a replacement product due to significant manufacturing defect or shipping damage
  • The product is lost in transit (with tracking documentation)

How: All approved refunds are processed by Gelato directly to your original payment method.

Important Notes

Shipping Damage: We cannot be held responsible for damage occurring after the product comes into your possession. Please inspect your package carefully upon receipt. If the packaging is damaged, please document it immediately and contact us.

Gelato's Responsibility: Gelato covers the cost of replacement products for verified manufacturing or shipping errors. As your seller, we work with Gelato to ensure you receive the correct resolution.

Preferred Timeline: While you technically have 2 years to file a claim, we can process claims much faster and more easily if you contact us within 30 days. After this period, it becomes difficult to verify transport or production defects.

Your Legal Rights (Danish Purchase Law)

Regardless of this policy, you always have a statutory right to claim for defective products within 2 years of purchase. You can demand repair, replacement, or in certain cases, a refund. We encourage you to exercise this right by contacting our customer service.

Further recourse: If we cannot resolve your issue satisfactorily, you may file a complaint with the Danish Consumer Complaints Board or contact the Consumer Ombudsman.
